INTRODUCTION
Huntessa S.a.r.l., registered at the Registre de Commerce et des Sociétés in Luxembourg offers its Customers Services with a view to selling and buying top end luxury branded goods in New Condition. These Services are available directly on the Website.
The purpose of the General T&C’s “Buying Products” is to define the terms and conditions on which HUNTESSA allows its Customers to buy Products on the Website. The General T&C’s “Buying Products” apply without prejudice to the stipulations in the General Terms and Conditions governing use of the website www.huntessa.com, which remain applicable in full.
1. REGISTRATION ON THE WEBSITE
In order to be able to make transactions on the Website, Customers must create an account using their email address and a password.
Users must be aged 18 or over and have full legal capacity to make a purchase. Only the registered Customer is authorized to use his/her account using an email address and the password created when registering with the Website.
Customers promise not to create or use any additional accounts using either the Customer’s own identity or the identity of a third party.
Customers agree to compensate HUNTESSA against all losses it incurs or suffers arising from the use by any other person accessing the Website using the Customer’s account information where he/she has permitted or knows about such use. The Customer may refer to the HUNTESSA’s Privacy Policy for further information, available on the Website.
2. BUYING PRODUCTS
2.1 Placement of an Order by a Buyer
The Prices of all Products listed for sale on the Website are inclusive of all taxes, excluding customs taxes, and appear on the Product Information page of a listed Product. The Price does not include shipping cost. Customs charges in force in some countries may be required to be additionally paid by the Buyer to the customs office of the Buyer’s country or if applicable through a shipping courier.
The Order is an offer by the Buyer to enter into a binding contract with the Seller. The sale is deemed to be completed once shipped.
2.2 Delivery and Shipping costs
Buyers must provide certain mandatory information which is essential in order to complete the Transaction:
- Surname, first name and, if appropriate, the surname and first name of the person to whom the Product is to be delivered, if different;
- The delivery address. This must be accurate and complete to allow and facilitate the shipping of Orders; and the invoicing address, if it is different form the delivery address
- A contact phone number is compulsory.
HUNTESSA shall ship the Order to the Buyer by any carrier it approves. The Shipping Costs are a contribution by the Buyer to the costs incurred by HUNTESSA (shipping, insurance or other costs, etc.) as provided below, for the shipping of the Product to the Buyer.
The Shipping Costs are set out below in respect of the different countries to which Orders can be shipped. Shipping costs may be modified according to the tariffs applicable by the carrier and will be stated at the time of the Order. The shipping costs applicable to the Order are those specified at the time the Order is placed. Shipping costs are fixed at the rates mentioned below.
Zone 1: Free
Zone 1 covers Luxembourg.
Zone 2: 25€
Zone 2 covers geographical Europe, including: Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Malta, Monaco, Netherlands, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Vatican City, United Kingdom.
Zone 3: 50€
Zone 3 covers the Rest of the World
2.3 Refusal of Orders:
HUNTESSA reserves the right to refuse an Order from a Buyer without providing an explanation, but, in particular, with whom a dispute exists. In this case, the Buyer will be notified by email of actions taken by HUNTESSA, which will refund the value of the Order if the Buyer has already paid.
2.4 Paying for Orders
The Price and Shipping Costs shall be paid by the Buyer via HUNTESSA’s secure payment system. The card details will not be saved or stored by HUNTESSA.
2.5 Ownership of the Products and Risk
The Products remain the Seller’s until HUNTESSA collects the full Price of the Order from the Buyer including any taxes, processing and Shipping Costs. The risk of damage to and loss of a Product sold to the Buyer shall pass to the Buyer on receipt of that Product. The Buyer shall therefore be liable for any damage caused to the Product following receipt.
3. RETURNS/REFUNDS
3.1 Return timeline
HUNTESSA takes pride in every item we sell, no matter what the reason is, we will accept a return within 7 calendar days upon delivery of the Product, except in the event of fraud of the Buyer. Returns outside of this period will not be accepted.
3.2 Return exception
Exceptionally the Returns won’t be accepted for the Hermes Birkin and Kelly bags. This is for a reason to exclude fraud and counterfeiting of the products.
3.3 Return process
To cancel the Order, the Buyer must complete the Return form via signing in to your HUNTESSA Account. If the Buyer returns the Product within the above-mentioned time period, the Buyer will be refunded by the HUNTESSA for the entire amount paid by the Buyer excluding the shipping cost within fourteen (14) days of HUNTESSA’s acceptance of the Return.
All Products that are returned will be inspected on return and, in all cases, the Products must be returned complete (i.e. with any accessories or other parts received with the Products). HUNTESSA reserve the right to reject the return if the Product is not complete or not compliant with HUNTESSA Return Policy. In this case the Buyer will be informed accordingly via email.
If the return is being accepted, your refund will be credited to the original payment method.
Outside the EU, customs duties are non-refundable through HUNTESSA. However, you may be able to recover these by contacting your local customs bureau directly. As this may not be available for all countries, we recommend that you hire a customs broker if you wish to claim back duties on returned Product.
3.4 Conditions for the Return
All items must be unused and with all HUNTESSA and (if applicable) designer garment tags still attached.
To ensure your return is covered by our Return Policy, the Product must be sent back from the same country it was delivered to and exclusively using the return label enclosed in the delivery. HUNTESSA takes no responsibility for those Products which Buyers decides to return via different non-authorized by HUNTESSA shipping courier.
Returns that do not meet our policy will not be accepted and sent back to the Customer.
3.5 Repeated Returns
We offer a flexible return policy to make your online shopping experience even easier. We do monitor the number of returns made by Customers, and continued returns will be flagged and may, at our discretion, lead to the closure of your HUNTESSA account or future orders being refused.
3.6 Colors
We have made every effort to display the colors of our Products that appear on HUNTESSA as accurately as possible. However, as computer monitors, tablets and mobile devices vary, we cannot guarantee that your monitor’s display of a color will be completely accurate.
